Terms and Conditions for Secure Digital Storage Service

These Terms and Conditions govern the use of the secure digital storage service provided by Speak From Beyond (referred to as “the Service”).  By using the Service, you agree to comply with these Terms and Conditions.

1. INTRODUCTION

These Terms and Conditions (the “Agreement”) govern your access to and use of the digital storage service platform (the “Service”) operated by Speak From Beyond LLC, a Washington limited liability company, with its principal mailing address at 19215 SE 34th ST #106 PMB#351, Camas, WA 98607 (“the Company,” “we,” “us,” or “our”). This Agreement constitutes a legally binding contract between you (“User,” “you,” or “your”) and the Company.

By accessing, registering for, or using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions set forth in this Agreement. If you do not agree with any part of these Terms, you must not access or use the Service.

2. ELIGIBILITY AND LEGAL CAPACITY

By accessing or using the Service, you represent and warrant that you are at least eighteen (18) years of age and possess the legal capacity to enter into this Agreement.  Use of the Service by individuals under the age of eighteen (18) is strictly prohibited.

3. DESCRIPTION OF SERVICES

The Company provides a subscription-based, tiered digital storage solution that enables Users to store personal digital files and sensitive information within a secured and individualized online profile.  Each User may:

  • Create a unique account with login credentials;
  • Upload and manage personal data including, but not limited to, name, address, and banking information;
  • Designate “Trusted Recipients” to access stored information upon the User’s verified death.

Under no circumstances will the Company access, review, or disseminate the contents of any User profile, except as required by law or court order.  The Service is intended for the secure storage of information only.  The Company disclaims any responsibility for the content uploaded by Users.

4. ACCOUNT SECURITY AND RESPONSIBILITIES

Users are solely responsible for maintaining the confidentiality of their account login credentials and all activities that occur under their account.  The Company shall not be liable for any unauthorized access resulting from User negligence or failure to secure credentials.

5. SUBSCRIPTION FEES AND PAYMENT TERMS

5.1. Subscription to the Service requires payment of fees based on the selected

All payments are processed via a third-party payment processor, currently Stripe, subject to change at the Company’s discretion.  By subscribing, the User agrees to:

  • Provide accurate billing information;
  • Authorize automatic renewal unless cancellation is made prior to the billing date;
  • Accept that changes to pricing or processors may occur with reasonable prior notice.

5.2. Late Payment and Account Deletion

If a User fails to make payment within thirty (30) calendar days after the payment due date, the Company reserves the right to suspend or permanently delete the User’s account.  This includes deletion of all uploaded files and any information stored within the User’s profile, which will no longer be retrievable or accessible.

In addition, a late payment fee of five dollars ($5.00 USD) will be charged for any overdue payments.  This fee is subject to change at the Company’s discretion with or without notice.

6. USER CONDUCT AND ACCEPTABLE USE POLICY

Users shall not:

  • Upload any illegal, defamatory, or infringing content;
  • Engage in unauthorized access or compromise platform security;
  • Share login credentials or permit unauthorized persons to access their account.

Violation of this Section may result in immediate termination of access, without refund, and potential legal action.

7. DESIGNATION AND ACCESS BY TRUSTED RECIPIENTS

Each User may designate individuals (“Trusted Recipients”) who shall be granted limited access to the User’s stored content only upon official confirmation of the User’s death.

The Company shall not be held liable for content viewed, shared, or utilized by Trusted Recipients.

Access will only be provided upon submission of sufficient legal documentation (e.g., death certificate) and after completion of the Company’s internal verification procedures.

8. DATA PROTECTION AND DISCLAIMER OF LIABILITY

8.1. The Company uses commercially reasonable measures to safeguard stored data.

However, the Company disclaims liability for:

  • Data breaches arising from acts of hacking, phishing, or third-party interference;
  • Compromises resulting from User negligence or failure to update access credentials;
  • Any consequential damages due to service interruption, data corruption, or unauthorized access.

By using the Service, Users acknowledge and accept these risks and agree to hold the Company harmless in the event of a breach or unauthorized access.

8.2. The Company shall not be held liable for any illegal data breaches, leaks, or unauthorized disclosures caused by third-party hackers or cybercriminals, provided such breaches are not the result of the Company’s gross negligence or willful misconduct. Users
acknowledge that while reasonable security measures are in place, no system is immune to sophisticated attacks, and they agree to hold the Company harmless in such instances.

9. MODIFICATION AND TERMINATION OF SERVICE

The Company reserves the right to:

  • Modify the Service and Terms at its discretion;
  • Suspend or terminate User accounts for violation of this Agreement;
  • Provide advance notice of material changes, except where prohibited by law.

Users may cancel subscriptions at any time; however, fees are non-refundable unless required by applicable law.

10. GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of Washington, State / Clark County.  Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts located in Washington, State / Clark County.

11. ENTIRE AGREEMENT

This Agreement, together with the Company’s Privacy Policy, constitutes the entire understanding between the User and the Company concerning the use of the Service and supersedes any prior agreements or communications.
